In the past, Smithsonian Folkways Recordings has incorrectly credited the composition “We Shall Overcome.” The source of this song is a spiritual, overheard by Zilphia Horton when being sung by Black tobacco workers in Tennessee. Horton, Frank Hamilton, Guy Carawan and Pete Seeger adapted it and changed some words, making it an anthem for the Civil Rights movement. In the early 1960s, they copyrighted the song and listed themselves as composers, out of concern that others would exploit the song commercially. All its royalties were paid to the nonprofit We Shall Overcome Fund, which provides grants to assist African American musicians in the South. In 2016, a court decision placed the song in the public domain.
